NEW: 90 Minutes After Trump Appealed his Slush Fund ruling, the DOJ Moved to Dismiss my Slush Fund Case as "Moot"
The timing is laughable
Back on May 28th, I sued Todd Blanche to stop the $1.776B “anti-weaponization” slush fund. Bloomberg reported:
The host of the “Mueller, She Wrote” podcast sued the Justice Department Thursday over its creation of the $1.776 billion “Anti-Weaponization Fund,” saying the federal government failed to follow required public comment procedures.
Allison Gill, who worked as a health specialist at the US Department of Veterans Affairs from 2009 to 2020, alleges the US Department of Justice violated the Administrative Procedure Act by creating the fund without publishing proposed rules in the Federal Register or allowing public comment, according to her complaint filed in the US District Court for the Southern District of California.
The fund was established through a settlement with President Donald Trump over lawsuits related to unauthorized disclosure of his tax returns and other government investigations and is designed to compensate victims of government weaponization. This challenge joins two other recent lawsuit challenging the fund on other grounds.
Since that day, the fight over the slush fund and tax immunity saga has grown louder, with the crescendo culminating in the postponed Judiciary Committee vote on Todd Blanche for Attorney General. Sens. Cornyn and Tillis refused to vote to advance Blanche’s nomination to the full Senate absent a written rescission of the slush fund and Trump tax immunity.
In the weeks leading up to the postponed vote, Todd Blanche has spilled vast amounts of ink in an effort to defend his refusal to rescind the slush fund in writing. A judge in Virginia in a separate law suit against the fund ordered Blanche to rescind the fund in writing to her under penalty of perjury, stating that asserting the end of the fund in court filings and certain testimony before Congress was not enough.
After Blanche testified during his confirmation hearing - testimony that did take place under oath - Blanche insisted that testimony should suffice, and that no written rescission is necessary.
But yesterday, Donald Trump posted on Truth Social that the fund is important to him, and that it was indeed meant to reward those who attacked the Capitol. He said he might withdraw Blanche’s nomination until Sens. Cornyn and Tillis are out of Congress, and then went so far as to appeal Judge Williams’ order in Miami that nullified referring to the slush fund as a “settlement” pursuant to a legitimate court proceeding.
Then just 90 minutes after appealing the federal court’s ruling on his slush fund, the same administration filed a motion to dismiss my slush fund lawsuit, claiming (among other things) that my lawsuit is MOOT because the “fund is not moving forward.”
Additionally, the Justice Department claims I lack standing, that the court lacks subject matter jurisdiction, and that I do not state a claim for which relief can be granted. We will argue against those claims, but the fact that the DOJ says my complaint is moot because the fund is dead just 90 minutes after Trump appealed the nullification of the fund is laughable.
