Steve, I think you're right and I've been asking the same question. Why have they not implemented the Insurrection Act? Probably because they're waiting for the "right" optics. A black or brown person, preferably a man, committing a type of act that the Right and moderates on the fence could stomach. I do think in leu of those conditions, the agitators on the right will infiltrate a peaceful protest and commit such an act and it will be blamed on the "Left."
Red states would happily go along with Trump's demands to end elections.
And he'll just send the military, national guard and ICE out to seize polling locations in blue states.
Sure, he doesn't have the authority to. But since when has that ever stopped him?
He didn't have the authority to put his sweeping tariffs in place, or murder fishermen in the Caribbean, or send the National Guard to attack cities, or have ICE murder Americans, or bomb the countries he's bombed at random, or invade Venezuela.
The law and Constitution mean NOTHING to fascists. And whatever he does, Republicans will back him. Even if a handful do some performative votes in Congress to act like they're trying to defend America.
Excellent podcast with Steve today. 🙏 Thank you 🙏, both. The Breakdown is a fav of mine because it answers questions about current legal issues and events. I hope it wins awards for this genre. 🏆
Another thought about delay in the use of regular military on the streets of America, the Insurrection Act, would draw down manpower. Putting them on our streets would dilute military resources making them less available for international policing action.
Great info - thank you very much. I understand what he was saying about the military being more constrained, certainly than ICE because they are far better trained. ICE is employing anyone including the Proud Boys. But I'm afraid it can and will get to the point that the president will try to order the military to do illegal things and they will have to push back and then many will get fired.
I think Trump could call for Martial law in light of his vindictive agenda. He will say that civilian law enforcement in Minneapolis, Minnesota in general as well as other sanctuary cities and states, are not doing, nor are they capable of doing their jobs, and he will "supplant" rather than "supplement" civilian law enforcement. We see that civilian law enforcement is not able to protect its citizens, as is their mandate, but rather they are handcuffed and castrated.
What if the insurrection act is actually part of a military strategy to get troops in Minnesota, at Canada’s southern border? Followed by an attack on Greenland, north of Canada. Followed by or simultaneous with an attack on Venezuela south of Mexico, combined with increasing military at Fort Bliss in Texas, north of Mexico.
Putin's exact playbook when he ASSURED THE WORLD that he had no intention to send his massing military "training exercise" over the border into Ukraine. Clearly, not a word from Putin or his puppet can ever be trusted.
We live in a tyrannical moment. This moment demands all Citizens to say no.
Thank you, that really helped my understanding.

Please ask Steve if ICE can station themselves outside voting locations and stop people. That is my fear.
My impression is the courts are trying to have this resolved by then. They don't need that any more thn we do.

My problem with Trump invoking the Insurrection Act is that he will give service men & women illegal orders (e.g. "shoot them in the legs").
Let's hope their training will make a difference

Thank you, Allison.
This was so informative. Please do more of these. Thank you
It is good to know the details of these laws however we will see if it makes any difference to the orange blob!
Thank you both. Slippery slope indeed.
Stephen Miller is behind ALL of this chaos. How do we rid ourselves of a non-elected "official" that lives in Trump's head.
