The Head of Trump's Gestapo Thinks Habeas Corpus is a Presidential Power

Today, DHS Secretary and Secret Police Czar Kristi Noem was asked by Senator Hassan - who hails from the “Live Free or Die” state of New Hampshire - “What is Habeas Corpus?”
Noem replied that Habeas Corpus is the PRESIDENT’S RIGHT to detain and remove people without due process.
The senator corrected her, but the writing is on the wall.
This all comes on the heels of Trump seething about a 7-2 Supreme Court decision that temporarily bars the regime from disappearing people to a foreign gulag without due process while the courts consider the legality of his Alien Enemies Act Proclamation.
Many are confident that the Supreme Court will rule the use of the Alien Enemies Act unlawful, but I have very little faith in the high court to do the right thing.
That Supreme Court injunction followed a ruling from them that struck down the nationwide class certification of those subject to the Alien Enemies Act Proclamation, requiring that individuals file Habeas petitions in the jurisdiction where they’re being detained. All of that led to Stephen Miller announcing that the administration is considering suspending Habeas Corpus altogether.
Trump’s complaint is that he shouldn’t have to afford due process to anyone because upholding our rights would take too long. Fascinating coming from the guy that was afforded more due process than anyone in history. On the other hand, the Supreme Court - who got us into this whole mess by granting the president dictatorial immunity - revoked Temporary Protected Status for up to 350,000 Venezuelans.
Meanwhile, the regime is going after the powers of Congress and the Judiciary in an effort to consolidate power. First, by violating the Impoundment Control Act to strip congress of their power of the purse. Then, by arresting members of co-equal branches of government.
Trump’s prosecutor in New Jersey announced a federal felony charge against Democratic Congresswoman LaMonica McIver for “SLAMMING”, “FORCIBLY GRABBING” and “FORCIBLY STRIKING” ICE officers during a legal visit to an ICE detention facility. None of that happened, and the charge was announced in the same press release that dismissed the erroneous charges against the Mayor of New Jersey, Ras Baraka, in the interest of “moving forward.”

The indictment says this is an instance of Congresswoman McIver’s “multiple attempts to forcibly assault, resist, oppose, impede, intimidate and interfere with the agents attempting to take the Mayor into custody.” That’s interesting considering Trump and Bill Barr argued there can be no obstruction without an underlying crime, not to mention Trump’s pardon of those who actually assaulted, resisted, opposed, impeded, intimidated, and interfered with law enforcement on January 6th.
I’d bet my paycheck these charges will also be dropped, if not easily defeated in court.
And speaking of easily defeating charges in court, the regime has also arrested and charged Milwaukee state Judge Hannah Dugan for allegedly helping a migrant evade ICE. The best part is that her lawyers have quoted Trump’s arguments for immunity back at him.
But whether these prosecutions are successful is not the point. The point is to intimidate, chill speech and oversight, and strip power from otherwise co-equal branches of government. Hell, the republicans even have a provision that curtails the court’s ability to use its contempt powers against the president tucked deep in the Billionaire Bailout Bill they intend to pass in the middle of the night.
In late November, still reeling from the election results, I contemplated the following on Bluesky: “…what if trump suspends Habeas Corpus under the old Habeas Corpus Suspension Act of 1863, asserting his political enemies are part of an invasion or rebellion and can be detained without due process?”
What if, indeed.

Noem digs in on the lies she and the regime continue to try to push, as they clearly know there are no teeth behind any of these proceedings or laws for them. Just my observation. They are smug in their indignant statements!
