Judge Cannon has Temporarily BLOCKED the Release of Jack Smith's Final Report
And she did it before Jack Smith could hand his report in to Merrick Garland.
Leave it to Judge Cannon to be an absolute terror.
Today, 45 minutes before Jack Smith was going to hand his report over to Merrick Garland for release, Judge Aileen Cannon entered an injunction order, blocking Jack Smith and the Justice Department from releasing any part of his final report. She writes:
Before the Court is an Emergency Motion filed on January 6, 2025, by Defendants Waltine Nauta and Carlos De Oliveira to Preclude Release of a Final Report by Special Counsel Jack Smith. The Emergency Motion, filed to preserve the status quo, seeks immediate injunctive relief to prevent irreparable injury from the reported imminent release to the public of a Final Report prepared by Special Counsel Smith. This morning, Defendants filed a nearly identical emergency motion before the United States Court of Appeals for the Eleventh Circuit in a pending appeal bythe Special Counsel of an Order Granting Defendants’ Motion to Dismiss Superseding IndictmentBased on Appointments Clause Violation.
The appellate motion seeks additional specific relief in the form of a stay or injunction pending appeal, along with an order remanding to this Court for consideration of the legality of any public release of the Final Report pending resolution of the ongoing appeal.
To preserve the status quo as this Court awaits resolution by the Eleventh Circuit of the similar Emergency Motion, to prevent irreparable harm arising from the circumstances as described in the current record in this emergency posture, and to permit an orderly and deliberative sequence of events, it is ORDERED AND ADJUDGED as follows:
Pending resolution of the Emergency Motion filed in the Eleventh Circuit and/or any further direction from the Eleventh Circuit, Attorney General Garland, the Department of Justice,Special Counsel Smith, all of their officers, agents, and employees, and all persons acting inactive concert or participation with such individuals, see Fed. R. Civ. P. 65(d)(2), areTEMPORARILY ENJOINED from (a) releasing, sharing, or transmitting the Final Report or any drafts of such Report outside the Department of Justice, or (b) otherwise releasing, distributing, conveying, or sharing with anyone outside the Department of Justice any information or conclusions in the Final Report or in drafts thereof. This Order remains in effect until three days after resolution by the Eleventh Circuit of the Emergency Motion, unless theEleventh Circuit orders otherwise.
Not only has she ordered that the Volume of the report that’s within her jurisdiction be prohibited from release - she’s barring the release of ANY part of the report - including the Volume on the DC January 6th case. Obviously, that’s outside her jurisdiction, so now Jack Smith has to go to the 11th circuit and ask them to undo at least that part of this ruling. Which takes time. I haven’t yet seen an emergency motion from Special Counsel to the 11th Circuit, but I expect he’ll file one.
Something else noteworthy: last night, Jack Smith responded to Nauta and DeOliveira on her docket saying he would file a full response today by 7 PM, and he promised he would NOT transmit his report to Merrick Garland until 1 PM ET today. She blocked the report’s release 45 minutes BEFORE Merrick Garland got the report, effectively blocking him from releasing it before she could stop him.
Finally, she is blocking the release of any part of the report to anyone OUTSIDE the Justice Department, which means Joe Biden can’t get his hands in on it and release it, nor can anyone in Congress.
Joyce Vance and Kristy Greenberg have agreed that this is now in the hands of the 11th Circuit. The only problem is that whatever the 11th Circuit decides, (if it decides anything before January 20th), is appealable to the Supreme Court.

But doesn’t Smith still have the hard copy that he can give to the DOJ or Biden? He needs to say eff it and give it to Biden. Then Biden releases it, preemptively pardons Smith and himself. Maybe Biden should just jail Cannon for obstructing justice.
President Joseph R Biden Jr as per the US Supreme Court and the US Constitution IS THE DEPARTMENT OF JUSTICE. He cannot be blocked by the Judicial Branch from anything in the Executive Branch. Basic interpretation of the Separation of Powers. He also has immunity for official acts while in office and can unconditionally release the report. Garland can also release it as per the statute. Again the Separation of Powers
