On "DHS refuses to release an email justifying ICE entering homes without judicial warrants"
I read your update last night on this (I think, I read so much it could have been someone else?) If I have the story right, you asked for the DOJ official documentation stating this practice was legal (presumably citing the rationale / authority for the legality of non-judicial warrants to invade private spaces, disregarding the IVth Amendment), their (delayed) response was that it didn't exist, and the only thing that did exist was an email, which now they refuse to present because. (Just because, like it's attorney-client privileged communication.
So, if I have this straight, ICE is acting in what is at face value a violation of the IVth Amendment, claiming they have an internal finding that it isn't in fact a violation, but at the same time stating they can't share that finding because it's privileged?
Seems to me the argument is that all these home invasions are indeed unconstitutional without written documentation as to the rationale, along with the internal ICE communications AND TRAINING to ICE officers as to under exactly what circumstances the findings apply, and how to constitutionally carry out such an operation. That the bias here MUST fall to the citizen's rights and not the government's desire to ethnically cleanse the nation.
I really hope this view comes out in your next filings. ICE's leadership and management down to the Agent in Charge that is signing these non-judicial warrants and directing ICE agents to violate the Constitution need to be held accountable for these actions, and this is as good a place as any to begin that process.
Allison Gill is one of best Substacks, hands down. And one of the best features, which others are now emulating are the HEADLINES! The headlines are what make draw me every day to this Substack. They are on target, intelligent, and very valuable. One other thing. Allison Gill makes the distinction between All Democrats and Some Democrats. Dems have to unite. They have to "accept" each other or they will lose. When critics, popular Substack figures, say that Democrats are doing this, doing that, it is not true that All Democrats are shooting themselves in the foot. Some are, yes, but most are not. It is harmful for fellow Dems to focus on the mistakes of a few and brand it as the whole Democratic Party. The Democratic Party has always had a diversity of opinion, and thus it is a harder group to "manage". It is harder to speak with one voice. Today, Democrats have to speak with one voice that is comprised of a diversity of opinions. It's like hearding cats. While we need all the voices, we need the nuance, we must speak with ONE united voice in order to win, and Allison appreciates that. Keep up the good work. Thank you.
